(a) The appeal was not timeosly lodged in relation to the original decision of the DDAFL from the meeting of the 25th August 2011
(b) The decision of the DDAFL to the deduction of 3 points remains in force
(c) The appeal fee is returned to Maxwelltown
Disciplinary Meeting 11th October 2011
Case 1 - Upper Annandale fined £40 for club official Alan Johnstone using foul and abusive language towards referee.
Case 2 - Upper Annnadale vs YMCA abandoned match 1st October. Committee decision was to allow the result at the time of the abandonment to stand (Upper Annandale 1-2 YMCA). Upper Annandale also fined £50 and had a levy of £25 applied till end of season.
The appeal was heard on on Wednesday 23rd November 2011
Upper Annandale appealed this decision on the following grounds
(1) All other abandoned matches have been replayed
(2) Why now has there been a change to DDAFL committte decisions?
Maurice Sproat attended the meeting on behalf of the DDAFL. Uppers were represented by Robert Smith and AlanJohnstone.
Mr. Smith indicated that the club felt the game had been abandoned as the referee had lost it and was shaking. The club had no qualms about the ordering off of their player but the referee had only given the player about 3 minutes to get changed and move from the side of the field. He felt the decision to allow the result to stand had been unfair as other games in this type of situation had been recast. His club were of the opinion that the committee member who proposed the motion to have the result to stand had benefitted from this decision.
Mr .Smith confirmed that the referee had advised his team manager that the game would be abandoned if the offending player did not leave the area of the pitch. Other games where the result had been allowed to stand had involved fighting with only a few minutes to go. Both managers of the clubs had appealed to the referee to continue the game. The club had challenged the content of the referee's report at the disciplinary meeting but the referee had stood by the content of his report. He accepted that the club had not assisted in ensuring that the offending player moved away quickly.
Mr. Sproat advised that there had been 9 members on the Committee with a vote of 4-2 to carry the proposal that the result has stood. Personally he could not follow the referee's report as it had not stated that the referee had not felt threatened. He had not liked the fact that the referee and the committee chairman had went outside to discuss the case.
Decision
The Committee on full consideration of the submissions made by the representatives of Upper Annandale and the DDAFL decided that:-
(a) The appeal is upheld to the extent that the misconduct report relevant to the abandoned fixture will be referred to the General Purposes Committee of the SAFA for their attention and action: and
(b)Upper Annandale will be cited to appear before the General Purposes Committee of the SAFA to answer specific charges that the club could have brought the DDAFL and amateur football into disrepute by the conduct and of their players, officials and spectators which led to the abandonment of the fixture in questions;and
(c) The DDAFL will be cited to appear before the General Purposes Committee of the SAFA to explain the apparent breach of procedures when dealing with the case relating to Upper Annandale; and
(d)In addition the DDAFL will be further cited to explain their failure to produce a properly completed and up to date minute book; and
(e)The appeal fee is returned to Upper Annandale AFC.
It is not clear from the decision whether the fine of £50 imposed by the DDAFL still applies.

As of the 14th January 2012 Maxwelltown Thistle have had their appeal against this decision accepted by the SAFA and are awaiting a date for the appeal. The decision to replay this game has been set aside and as a result the game result stands. Lochar Thistle have also appealed but due to a postal issue are awaiting a decision on whether their appeal was lodged in time. Tony Pierog Trophy Rules for 20010/11 season.
The scoring system for the Tony Pierog Fair Play Trophy has never been witten down and the trophy rules have been at the discretion of the General Secretary since its inception. Usually it has been based on cautions and sendiings off and referees committee appearances but this year other things such as late results etc. have been taken into account.
To make the system totally transparent the rules need to be added to the constitution. The following proposal was accepted by the member teams at the 2009 AGM and will be in force for the 2009/10 season onwards.
Points System for Fair Play Trophy
Caution 1 point
Sending off 1 point per game suspension
(related to sending off offence)
Player reaches 5 Cautions 3 points
Player reaches 10 Cautions 6 points
Player reaches 15 Cautions 10 points
Dated Suspension 1 point per week
(Maximum 50 points per offence)
Referee committee committee
citation that is upheld 5 points
Minor rule infringements
(late results, failure to
attend meetings etc.) 1 point per £1 fined
Any outstanding offences at the end of the current Season and not dealt with until the start of the forthcoming Season, the penalty points, shall be effective for the Season when the offence is dealt with.
